Metering Returns

Just in time for Mother's Day, the Department of Homeland Security announces new enforcement priorities for migration across the Southern border. Beginning May 11th, the US plans to return to processing migrants under Title 8, requiring authorized entry to avoid expedited removal. Furthermore, DHS proposes to presume asylum applicants ineligible if they cross the Southern border irregularly. While we at Hannibal Legal question if this proposal violates international law, it undoubtedly will lead to more expedited removals until this question is litigated in federal court.


To facilitate this new policy, DHS promised expanded access to an app they have developed for scheduling an appointment to approach a port of entry. This seems suspiciously like a return of the Trump-era policy of "metering" the number of asylum seekers that enter the US, despite the legal right of any migrant to request asylum.

En tiempo para el Día de la Madre, el Departamento de Seguridad Nacional anuncia nuevas prioridades de cumplimiento para la migración a través de la frontera sur. A partir del 11 de mayo, EE. UU. planea volver a procesar a los migrantes bajo el Título 8, que requiere la entrada autorizada para evitar una expulsión acelerada. Además, DHS propone suponer que los solicitantes de asilo no son elegibles si cruzan la frontera sur de manera irregular. Si bien en Hannibal Legal cuestionamos si esta propuesta viola el derecho internacional, sin duda conducirá a una expulsión acelerada hasta que esta cuestión se litigue en un tribunal federal.


Para facilitar esta nueva política, el DHS prometió ampliar el acceso a una aplicación que han desarrollado para programar una cita para acercarse a un puerto de entrada. Esto parece sospechosamente un regreso a la política de la era Trump de "metering" el número de solicitantes de asilo que ingresan a los EE. UU., a pesar del derecho legal de cualquier migrante a solicitar asilo.
